User Agreement

LLC "Women's Football Club "Dynamo-Moscow", which is a legal entity created in accordance with the legislation of the Russian Federation, OGRN 1247700665871, INN 9710138641, KPP 771001001, address 125047, Moscow, internal territory of the Tverskoy municipal district, 4th Lesnoy lane, 4 (hereinafter referred to as the Club) offers the Internet user (hereinafter referred to as the User) - to use the Club's services on the official website of the Club on the Internet https://w.fcdynamo.ru/ (hereinafter referred to as the Site) on the terms set forth in this User Agreement (hereinafter referred to as the Agreement).

1.        CONCEPTS AND DEFINITIONS

User – a legal entity or an individual with full civil capacity under the legislation of the Russian Federation (Article 21, Article 27 of the Civil Code of the Russian Federation), which is a party (hereinafter referred to as the Party) to the Agreement, who has voluntarily completed Registration on the Site and/or uses the Content of the Site.

Registration – a procedure during which the User provides an email address, password, and reliable information about themselves in the form approved by the Club (hereinafter referred to as the Registration Form).

Conclusion of the agreement – ​​the moment of conclusion of the Agreement between the User and the Club, confirming the User's consent to all the terms of the Agreement, is the completion of the Registration on the Site by the User or the moment of starting to use the Content of the Site.

Email address – the email address (e-mail) of the User, specified by him during registration to identify the User and used in combination with the password to gain access to the Services of the Site.

Password – a set of characters (letters, numbers, signs) specified by the User during registration, used in combination with the email address to allow the User to access the Site Services.

The Club's Site is an information resource, which is a set of computer programs that provide publication of information, data, advertising, text, graphic and/or audiovisual and other works and objects, posted or planned to be posted on the Internet page https://w.fcdynamo.ru/ as well as at other addresses at the discretion of the Club.

The Site Service is a set of services provided by the Club to the User(s).

The User's Personal Data – data voluntarily specified by the User during Registration and on the "Personal Account" page, which are stored in the Club's database and are subject to use exclusively in accordance with this Agreement, the document "Personal Data Processing Policy of JSC Football Club Dynamo Moscow" and the legislation of the Russian Federation.

Materials – information in any form (video files, audio files, photographs, images, text and any other).

2. SUBJECT OF THE AGREEMENT

The use of the Club's services on the Site (hereinafter referred to as the Services) is governed by this Agreement, as well as the terms of use of individual services, if they are posted on the Site. The Agreement may be amended by the Club unilaterally, the new version comes into force from the moment it is posted on the Site.

3. RIGHTS AND RESPONSIBILITIES OF THE PARTIES

3.1. The Club has the right to:

3.1.1. Provide the User with the opportunity to use a particular service of the site only after the User has registered on the site.

3.1.2. Entrust the processing of the User's personal data for the purposes specified in this Agreement to third parties on the basis of an agreement with them. In this case, third parties are obliged to maintain the confidentiality of the User's personal data and ensure its security. In the instruction to process personal data, the Club specifies a list of actions with personal data that third parties have the right to carry out, and the requirements for the protection of personal data that third parties are obliged to comply with. The User gives his consent to the processing of personal data by third parties with whom the Club has concluded agreements, when registering on the Club's website. The names and addresses of third parties entrusted with the processing of the User's personal data are indicated on the Club's website.

3.1.3. Supplement, delete or otherwise change the information presented in the Club Content, including inserting advertisements, hyperlinks, etc. into the Content.

3.1.4. Use the Users' registration information for the following purposes:

-      Providing the user with personalized Services;

-      Communication with the user, including sending notifications, requests and information regarding the use of the Services, the provision of services, as well as processing requests and applications from the user (for example, if the User has forgotten their password - in relation to Services containing a password);

-      Improving the quality of the Services, the ease of use, developing new Services and services;

-      Conducting statistical and other research in order to determine the information that Users need;

-      Conducting news and advertising and information mailings about the Club Services, special offers; products and services of selected partners to the extent permitted by applicable law.

3.1.5. Prohibit the use of certain logins, as well as establish requirements for the login and password (length, acceptable characters, etc.).

3.2. The Club undertakes to:

3.2.1. Provide technical support to Users in the form of written and/or oral telephone consultations, provided only upon sending an official request by the User to office@w-fcdm.ru. A specialist consultation can be provided on the following issues: registration and problems during its completion, the functioning of any of the site services put into operation, recovery of a lost password. Consultations are not provided on issues of setting up equipment, software or Internet access for the User or other third parties, as well as on other issues not related to the operation of the site services.

3.2.2. When processing the User's personal data, be guided by the current legislation and the "Policy on the processing of personal data of the Women's Football Club Dynamo Moscow LLC (https://w.fcdynamo.ru/club/policy), including ensuring the safety and confidentiality of the Users' personal data.

3.3. The User has the right to:

3.3.1. Use all the services of the site put into regular operation in ways not prohibited by this Agreement and the current legislation of the Russian Federation.

3.3.2. Contact the Club at loyalty@fcdynamo.ru to clarify the situation and take the necessary measures in the following cases: a) technical problems arise in the operation of the Services; b) the User receives messages that are unauthorized advertising mailings or contain materials prohibited by this Agreement, including threats or files suspected of being a virus; c) the User discovers facts that give grounds to believe that his/her access has been used by someone without authorization;

3.3.3. The User independently selects a login (a unique symbolic name for the User account) and password to access the account.

3.3.4. At any time, make changes to his/her personal data, including changing the password.

3.3.5. If the User does not wish to receive mailings from the Club's services, he/she must opt ​​out of receiving such mailings at any convenient time by clicking on the "Unsubscribe from mailing" link, which is located in every letter sent to the User's mailbox from the Club.

3.3.6. The User can also delete the registration information provided by him/her within a specific account by writing a request in any form to loyalty@fcdynamo.ru. However, deleting the account may result in the inability to use some of the Club's Services.

3.3.7. The User may revoke consent to the processing of his personal data by submitting an application in simple written form using postal communication, namely by registered mail with notification to the address of the Club's location, according to the Unified State Register of Legal Entities.

3.4. The User undertakes to:

3.4.1. The User is deemed to have accepted the terms of the Agreement in full, without any reservations or exceptions, after completing the registration procedure on the Site. If the User disagrees with any of the provisions of the Agreement, the User has no right to use the Services. If the Club has made any changes in the manner provided for in paragraph 1.2, with which the User does not agree, he/she is obliged to stop using the Club's services.

3.4.2. The User is solely responsible for the security (resistance to guessing) of the password chosen by him/her, and also independently ensures the confidentiality of his/her password. The User is prohibited from sharing the password from his/her account.

3.4.3. Immediately notify the Club of any case of unauthorized access to the Club's Services using the User's account and/or of any violation (suspicion of violation) of the confidentiality of his/her password, and also immediately change his/her password in the User's "Personal Account". In case of failure to notify or refusal of the User to change the password, the User is solely responsible for actions performed using his account. For security purposes, the User is obliged to independently perform a safe shutdown under his account (the "Exit" button) at the end of each session of work with the Club services.

3.4.4. Use the Site Services only for personal needs.

3.4.5. The Club owns exclusive rights to the content of the Site and individual elements of the site, including the Services (except for cases separately noted in the content of the materials published on the site). The User has no right to reproduce, distribute, bring to the attention of third parties, or use in any other way the content of the Site, except for cases when the User has received such permission from the Club, or when this is expressly provided for in the user agreement of any Service.

3.4.6. Fulfill all the terms of the Agreement.

4.    ACCESS TO THE SITE SERVICES

4.1. The User independently accesses the Site Services and Content.

4.2. The User is responsible for the accuracy of the personal login or account data provided on the Site within the framework of the Agreement, and undertakes not to transfer this data to third parties, and also agrees to bear responsibility for the consequences of transferring such data to third parties.

4.3. Registration completed by the User on the Club's website provides the User with access to the Club's website services.

5.    USE OF THE USER'S PERSONAL DATA

5.1. The User's personal data is processed by the Club in accordance with the Terms of Use of the Sites and the "Personal Data Processing Policy of Women's Football Club Dynamo Moscow LLC" as amended, published on the Club's Website https://w.fcdynamo.ru/club/policy/.

5.2. The User of the Agreement undertakes to familiarize themselves with the documents specified in paragraph 5.1 of the Agreement and to comply with the provisions of these documents, the violation of which may entail the violation of the rights of the Club and third parties.

5.3. The User's registration information is kept confidential, i.e. no information specified during registration is transferred to third parties without the consent of the User, except in cases stipulated by the current legislation of the Russian Federation.

5.4. In the event that the User voluntarily provides information about themselves for general access to an unlimited number of people when using individual Services, the User agrees that such part of the information provided by them, including personal information, becomes publicly available.

6. LIABILITY OF THE PARTIES

6.1. Liability of the Club:

6.1.1. The Club undertakes to ensure the stable operation of the Services, their gradual improvement, the fastest possible correction of errors in the operation of the Services, however, the Services are provided to the User on an "as is" basis. This means that the Club:

-      does not guarantee the absence of errors in the operation of the Services;

-      is not responsible for their uninterrupted operation, their compatibility with the software and technical means of the User and other persons;

-      is not responsible for the failure to fulfill or improper fulfillment of its obligations due to failures in telecommunications and energy networks, the actions of malicious programs, as well as the unfair actions of third parties aimed at unauthorized access and (or) disabling the software and (or) hardware complex of the Club.

6.2. User's Responsibility:

6.2.1. The User is responsible for providing accurate information during Registration.

6.2.2. The User agrees never and under no circumstances to use the Services to mislead anyone by appropriating someone else's name, email address and (or) password.

6.2.3. By joining the Agreement, the User understands, accepts and agrees that he/she bears full personal responsibility for the safety of his/her account (E-mail address and Password), as well as for all actions performed under his/her account; uses all the Site Services at his/her own risk.

6.2.4. In case of violation by the User of any of the terms of this Agreement, the Club reserves the right to terminate the User's access to the site services.

6.2.5. The User undertakes to compensate the Club for any losses incurred by the Club in connection with the User's use of the site services in violation of the Agreement and the rights (including copyright, patent, information, etc.) of third parties.

7. INTELLECTUAL RIGHTS

7.1. The Site Services, their components and individual components (including, but not limited to: computer programs, databases, codes, underlying know-how, algorithms, design elements, fonts, logos, as well as text, graphic, sound and other materials) are objects of intellectual property protected in accordance with applicable law, any use of which is permitted only on the basis of the permission of the copyright holder.

7.2. Illegal use of the intellectual property objects specified in paragraph 7.1 entails civil, administrative and criminal liability.

7.3. The User has no right to replicate or otherwise copy, distribute, modify, reformat or otherwise process the Site Services, their components and individual components, including frames and screenshots. Any components of the services may not be used as part of other websites, software products, search engines, other works and objects of related rights, copied or otherwise used for the purpose of deriving material benefit without concluding a corresponding Agreement with the Club.

8. FORCE MAJEURE AND EXTRAORDINARY CIRCUMSTANCES

8.1. The Parties shall not be liable for the breach of their obligations that arose after the Agreement comes into force if such breach is caused by force majeure circumstances.

8.2. Force majeure circumstances mean extraordinary circumstances beyond the reasonable control of the Parties, including, but not limited to, the following circumstances: war or other military actions (regardless of whether the war is declared or undeclared), occupation, actions of foreign adversaries, mobilization, requisition or embargo; ionizing radiation or radioactive contamination caused by a certain type of nuclear fuel or nuclear waste resulting from the combustion of nuclear fuel, toxic radioactive explosives and other harmful properties of explosive or detonating nuclear devices or nuclear components; coups, revolutions, riots, military dictatorship or seizure of power, civil war; uprisings, unrest, riots; fires, earthquakes, floods; acts and actions of state bodies that make it impossible to fulfill obligations under this Agreement in accordance with the legal procedure.

9. DISPUTE RESOLUTION AND CLAIMS SATISFACTION

9.1. All disputes and claims shall be settled on the basis of the provisions of the Agreement, and in the event of their failure to be settled, in the manner established by the legislation of the Russian Federation.

9.2. Any questions, comments and other correspondence from the User should be sent to the Club at the following email address: office@w-fcdm.ru. The Club is not responsible for and does not guarantee a response to requests, questions, suggestions and other information sent to it in ways other than those specified above.

9.3. All claims arising in connection with the Agreement shall first be sent by the User to the Club of the Site Services at the email address specified above. The Club undertakes to respond to the User's claim within 10 (ten) business days by sending a letter outlining its position to the email address specified in the claim. At the same time, the Club will not consider claims of the User that cannot be identified on the basis of the data provided by him/her during registration (including anonymous claims). If the User does not agree with the reasons given by the Club in response to the claim, the procedure for its settlement is repeated by sending a reasoned response from the User by post, namely by registered mail with notification to the address of the Club's location, according to the Unified State Register of Legal Entities. If it is impossible to resolve the claim through negotiations, the dispute is resolved in the manner prescribed by the Agreement.

9.4. The User and the Club agree that all possible disputes arising in connection with the Agreement are resolved by the Parties in accordance with the norms of Russian law and are considered at the address of the Club's location.

10. ADDITIONAL TERMS

The Club reserves the right to unilaterally and without prior notice to Users change the terms of the Agreement, posting the final version of the Agreement on the page at https://w.fcdynamo.ru/club/agreement/.

The provisions of the new version of the Agreement become mandatory for all previously registered Users of the Site.
